Hi,
I see from recent posts that mushrooms might meet the functional need. Are there any other horticultural businesses that would qualify as a main enterprise?

It seems that horticultural businesses struggle to meet the functional need for the neccessity to live on site - you could try googling the key words as I have just done and it throws up some interesting situations - it seems that other horticultural businesses have come up against this problem and have tried to get around it by having livestock based sidelines. Piglet.

I do know of one horticultural business which managed to obtain permission - it would probably depend on the size of the business. They are growing organic vegetables and have shop and cafe. The fact that they have 3 polytunnels probably helps towards functional need because of the early morning and late evening closing and opening of the doors and the frost factor.

Hi - we were under the impression that qualifying enterprises were touched upon in Dave's books.
We have it on very good authority though that blueberries do NOT meet the criteria for functional need. An application for a temporary dwelling on a blueberry plantation was turned down with the words, 'No functional need', and there was the same result upon appeal.

This is an interesting one planners turned it down and also lost on appeal but elected councillors changed the enforcement terms.

Read somewhere a case won on appeal I think for a vineyard reasons given for functional need were High set up cost and extreme risk especially in the first few years of preditation from deer ,frost damage,and the need for spraying at key times in the day when temp and wind conditions are optimumn ie 5am 10pm. Think that falls more into seasonal but could be combined with others.
Dave C think that is the first case I have seen that has put a time frame ie 2 years to comply with an enforcement notice,they have effectively achieved Temp Dwelling ! I wonder if they are paying council tax after that decision ?
Cornish "Never Say Never" if you are to establish your "Unique High Value in High Demand extremely difficult to produce without high labour input which results in a High value Blueberry crop from Cornwall which you have a demand for both locally and in a Covent Garden deli etc etc etc I think a static is essential.
"I Must Not Say Never" x 100 and I wont tell you again
is a bit of a long shot mind !

Interesting article on this case where planners ask councillors not to apply common sense to planning decisions. I take it that they think planning legislation does not make sense.
Or in other words yuou may be elected but we want the power.
