I accepted the offer from SSE yesterday to provide my 3 phase electric for free, cheers to all those that assisted me (LN) i know the CL is no longer here but wanted to say whoop whoop cheers

Do you think it's the CL that won, or the simpler solution for them.  We've an ongoing dispute with the electric lines going across our land and the guy who came out confirmed that they would have to remove the lines from our land if we required it.  I guess that leaves them two choices, move the line to the neighbours land and negotiate a wayleave or whatever with them, or agree something with us and keep the lines where they are.  Number one would be the easier cheaper option I imagine.  Would be interesting to see the correspondence you have with them though if you were able to forward it?  Might be able to use it to help with our issue - but I think like the parking tickets, you put up an argument and they have to consider is it worth arguing if there's an alternative solution

Common law has within contract law - principle being no man (CL) can be compelled to perform on another mans contract.

They rely upon statute law regarding way leave payment caps, however when notified correctly under common law it is my experience they realise they are dealing with a man and therefore have no authority and the statute law on which they rely has no authority. Are you in contact with the common law person? Lumpnuggin....

Not for awhile.  Would just be interested to read your letters back and forth and see if I can adapt to resolve our situation.

I got the impression from W P D that they are used to people negotiating wayleaves.

 

Common Law just gave me the confidence to go or it properly... I daresay there were other ways.  The thing is, the result for me was easy, whether other ways would have got Tony's result is a separate question.

I tried straighforward sensible legal debate with them and had got quite advanced with SSE prior to CL involvement 

it reached a stale mate and no pass...

 

CL notices got it sorted..

Why not do Xmas trees in pots , 5ft £25 , extra for delivery and do a buy back sceme for £10 if you collect after Xmas
Then sell it back to them next year , better still start at 3 ft
When they get to 7 ft chop them if and sell like that

plant an acre of trees, 4000 max, but say 2500

 

They grow to 5 ft tall

 

They retail at £25 each - crop is worth £50,000 +

 

A big man appears holding a baseball bat and explains his friends with chainsaws are taking them. He seems friendly enough as long as you don't object. He doesn't leave his business card.

 

Or, if this doesn't occur, as presumable it won;t, you get turf wars from whereever you sell them from.

 

Just my concern - is it a real concern, or imagined?
