Anyone got any advice/observations on this one? The applicant puts in a 28 day notice- the LPA reply within 28 days and say they want prior notification for design, siting and appearance - (the LPA seem to think that they only need reply within 28 days and do NOT have to determine the application within that timescale?) - then they refuse the application for prior approval with  officers recommendation 'application for prior approval refused' - for reasons not relevant to agricultural buildings seemingly? 

 

I am not the sharpest tool in the box - but can they do this???  :fie:

 

My reading of other posts is that as the LPA have not determined within 28 days this applicant can get on and build his agricultural building?
