I applied for pd for my barn in dec , lpa REFUSED PERMISSION, on siting ,design , size and appearance, I was told I would have to apply for full planning permission , there was no second stage .To save time on appealing I spoke to chief planning officer who advised reduce the size and appearance and they would look at it again , I provided business plan to show agricultural need , reduced size , change cladding from green box profile to black weatherboard so that the building resembled a traditional Essex barn .Hand delivered application on 21 st feb and got the clerk to check all forms were correctly filled in and got a date stamped receipt.No response from council by 21 st march so I sent an email on 24 th to ask if I could go ahead, the response was no you have been refuse permission and require full planning application!Technically this response came too late by 3 days so I should be able to proceed but has anyone done this and been issued with an enforcement notice?I have instructed a planning consultant who agrees I should just build the barn since they were out of time , she is also pointing out to them that they have dealt with the matter incorrectly, waiting to find out today what they have to say about it all!

28 days expired , council replied 3 days late with refusal should I build?
