Hi All
could anybody tell me if i can put a gateway into my land to gain access as the access i use is a bit too tight for getting certain bits of equipment and farm machinary in and out. The access i use i also a shared acces and owned by my neibour so i would like my own. The gateway i would like to put in would lead on and off the public highway and i would also need to put a drop kerb in would i be able to do this without planning or would i need it? I guess i would need it for a drop kerb but dont know about the actual gateway.I have also been informed i need planning permission for a polly tunnel because i need to dig the sides in to hold it down however they dont see a problem ( £70 bet they dont) I am trying to run a business from there but i am not sure if they can block me from running a business from my land due to access issues and finally i have had a caravan on there for about 5 years now unapproached touch wood would i have any good grounds or rights to keep it on there ? if i was approached if i do have any grounds or rights would i get away with changing it for a static ?

Is the road your land on classified? In my instance my lane was unclassified allowing me to put an access in without any need for PP..
If it is classified then you will need PP which will also give highways a reason to comment.

Interesting read is the hedgerow removal 1997 it lists exemptions which you might be able to apply without gaining planning permission if you remove less than 20 metres you dont need permission

Hi The road is as far as im aware a b road with a national speed limit on it there is a hedge row of thorne and blackberry the usual stuff and also some trees some of which are about knackered there are two good trees about 30 / 40 meters apart which is where i would like to put my new gateway between them my fence line to the kerb is about 8 to 10 meters which also includes a ditch

thanks for the replies i will look into the 1997 headgerow removal thing could anyone tell what would define a classified road would it be a bus route or is it if it is lit up if so the road im on has none of these

Check with your local highways department. It can be an A, B, C or D road or U for Unclassified.

A classified road is A, B or C class (section 12(1) Highways act 1980) all others are unclassified for planning purposes - read the excemptions for hedgerows and with or without hedgerow consent you need to close up the existing access when you open a new one.
As you say yours is a B road, so that is a classified road therefore you need planning permission, contact your County Highway authority first because if they aren't on-side you won't have any chance to get planning permission - so save yourself forking out for the fee and the other application costs until you've discussed it with the highways department.

I'm now going through the same thing if it's a b road at 60mph u will need to prove a visibility splay of 215m either way with a 2.4 depth. Highways are really against a new entrance so good luck with that one.
