I was refused pp so I believed I had the choice to a free appeal or to re submit an improved application within the 6 months period following the refusal.
I also received a PCN toward the end of this period.
Things were starting to look a bit serious so I decided that the better route now I risked losing everything would be to submit a stronger application.
I enlisted the services of a local planning consultant. This person had won several cases in the local area and I was starting to feel I was losing the confidence to go it alone.
I will try to keep this brief as possible but basically the consultant failed to submit the application within the timescale and an enforcement notice was promptly served. (Dam you LPA vultures)
The consultant did then submit an application but the LA have now said that as the application now included a livestock building that was not on the original, that they would treat this as a brand new application anyway so that cost me another 405.00
I have a copy of their correspondence which says I have until 24th Feb to appeal the enforcement at a cost of 670.00
The LPA officer says I should appeal (he would as half of the fee goes to him) as they could remove the mobile home and hard standing and septic tank plus me from the site before I have the chance to appeal if the new application is refused.
Should I appeal the enforcement or wait for the outcome of the improved application then appeal as soon as I know the outcome of the current application if it fails? Can they remove me whilst the application is waiting for the appeal hearing? Would I really have to move off then back on?
I can think of at least a hundred things to spend my hard earned cash on but the LPA are going all out on this one.
This all seems very unfair which seems to be the norm.
I am angry about the consultant missing the deadline as I could have appealed for free. I can hear a resounding cry to ‘kick ass’ in my head but I need the support of the consultant as he is meeting the LPA
