hi all i wonder if any body can shed any light on this...
we are thinking along the lines of alpacas as our functional need. now we have been doing some homework on the alpacas and have visited some breeders in wiltshire in the last few months, and one that we met said that if there are houses locally to our land forsale the council would expect us to purchase one of these to manage are land from, and not allow us to live on the land because there are houses available locally. would this be the case, even if we couldnt afford one of these have they really this much power..if this is the case should we be looking for land in the middle of nowhere..
look forward to any feedback.
regards jeff

Jeff, this is not always the case it will depend upon the LPA, however the further you are away from a village the better. The concil cannot make you purchase someting you cannnot afford.

We had an interesting conversation with a person who back in the '80's had a mobile home on a small plot of land being less than 1ha, the local council tried to have him removed and the appeals and court case went on for a number of years. There were local houses available for him and his spouse but this was outside of their finacial means at the time. At the final court case the local council was instructed to back down and pay this persons expenses. The reason was that during this debacle the person in question wrote to the then PM, Margaret Thatcher. Who wrote to him telling him that the council could not force him from his home unless they are prepared to rehouse him and should there be a need for him to live close to the area where he had his mobile home they would have to ensure that there was housing there for him. The council duly backed down and he was awarded costs and compensation for stress and harassment.

Not sure if it would still apply today. but if you do go and live on your land and the council tries to eveict you they still do have a duty of care to rehouse you even under current law.

All the best.
