It was Magistrates court. We had a solicitor. Our case was based on the fact that there were no Information booklet enclosed or Appeal form."which must be included" If we had the enclosed booklet we would have seen that the £660 stated on the Enforcement Order would only be applicable if appealing under Sec; A The Magistrates decided that this ommision did not make it a nullity. We were found guilty and Appealed . Prior to case being heard our Barrister advised we might lose. (we are on pension and housing benefit so have legal aid) Local planning e-mailed Barrister and said we could apply for planning. We now have to do that but don't know what fee is involved..2 mobile Wooden buildings on metal skids 30ftx12 ft . 1 Wooden building on metal skids 24ftx12ft.
We have 2.4 hectares bought as Agricultural land. Sheep have grazed for last 19 years and ponies grazed 10.years.We can't afford planning consultants etc.so any advice would be much appreciated. We went to see Head of Opposition at Cardiff who wrote to Council on our behalf Reply was " without wishing to trivialise the matter we would think that the Assembly would have better things to do than discuss the problems of someone blatantly disregarding planning law" "besides which they are not resident here" Both comments are unacceptable and also incorrect. The local AM.also wrote on our behalf August 2011 . He received a reply May this year! I was under the impression that Enforcement Orders were a last resource. Not in Our case. One phone call and several letters. All this down to a NIMBY neighbour who frequently makes complaints to the local authorities about all and sundry.

Take them to the small claims court for vet fees and get Defra on board

How dare unelected civil servants say this to elected officials?! How do they get away with it?!

i forgot to say that the council have agreed with the need and siteing of our field shelters and offer no objections.
