A Council I know have recently awarded 'class A permitted development rights' i.e. building an agri barn in this instance, to a holding of 4 acres, a 'class B' holding.
After a bit of research I have concluded that the development is not lawful and that any certificate is issued in error.
In this instance, it matters not too much for the applicant as long as no one finds out. The applicant would just need to apply for a certificate of lawful development after 4 years. The benefit now being that the applicant would then have 'full planning permission.'
The Council in this area have very patchy understanding of planning law, it's quite strange.
Any other views on this? I've come to this conclusion from Martin Goodall's blog info and reading between the lines.
If I was a trouble maker, or say, that Council made trouble for me, I suppose it would not hurt to drop it into conversation.
