Got a whole broth of stuff the planners are doing (more through incompetence than conspiracy we feel) including not replying to any emails, or phone calls, "not recalling" whole repeated conversations we have had, sending the wrong papers to the parish council, and most recently managing whilst not replying to an email from us about which deadline we were supposed to use (they gave us TWO notices, one wrong) they somehow posted our email question as a comment on their website to our *own" application...and then logged it as an *objection*...(argghhh...).
Anyway...my current question. We submitted our full PA in Feb; have had it discussed by Parish Council and received unanimous vote in support; the planners made a decision *before* the end of the consultation period and told the Parish council they were looking to refuse; the Parish Council stood its ground and said they "disagreed to disagree" and therefore the application would go to committee and not be decided under delegated powers. Good news so far.
Except now I have been told by the clerk to the Parish Council (very nice chap) that its due to go the meeting next week; I have been told by the local cllr (also very helpful) that it's to go to the meeting in May, not April; and when I asked the planning dept for clarificaiton today (they never answer emails, but I send 'em anyway) they said it wasn;t down for a committee decision and it was going to be decided under delegated powers.
In the meantime they're still posting comments on the website despite the deadline being missed (good and bad, as we have only 2 objections and 69 in support) and not contacting me in any way to say which meeting it's to be heard at. I have to request to speak by sending in a form two working days beforehand - which means tomorrow if the meeting is next week, given the bank holidays.
Question:
are planners allowed to make a decision before the consultation period is up?
are planners allowed to make a decision under delegated powers even though the parish council has requested it be sent to committe?
and if the "determination date" is 13 April (apparently) does that mean it HAS to go to commitee next week, or does it not mean that?
