i have a barn with horses in and have applied for change of use but the highways request the planning refused because of my entrance onto the public road i have opened the splays as much as possible on both sides without going on neighbours property but just doesnt give me enough visibility the neighbours wont let me cut any of there hedges can any body help with this problem thanks

How interesting!  And how funny and extraordinary!  Why did they allow the building of the barn in the first place?

What change of use are you wanting?  As far as we can see it, we do not understand it.  You already have an entrance and can use it to access your land - in what way will a change of use affect that?  Has anyone suggested using those special mirrors on the other side of the road?

If the Highways Agency is so concerned and as there is already an access to your land, ask them if they can help you improve on the existing visibility, because they have now pointed out to you that it could be dangerous if left as it is.

Hi, what change of use are you applying for, is it Agricultural to leisure (equestrian) or leisure to agricultural ?. Also bear in mind if you are just grazing, horses, this is an agricultural use.

sorry the change of use is from agricultural to equestrian the track to my field has been there for about 20 years the highways say that because we have put in for change of use this effects the entrance the farmer has been using the road all the time and there is a public footpath along it

I presume you are wanting equestrian business as opposed to private equestrian use.

The visibility limits have altered recently might be worth asking for, or finding out what they are.
We have applied to open a trekking centre - Highways stopped us as they don't want horses mixing with high speed traffic on the road, we also run a home boarding business from our home that we would have taken to our temp dwelling on our land.  Highways have no problem with vehicular (even business) access as long as we make the gateway 6m wide with a depth of 10m from the road, to prevent cars waiting to turn in if one is coming out.  Can you set your gate back?  What actual reason do they give, sometimes they misunderstand your reasoning, what is perfectly clear to you may not be so to them.  Pictures/maps/measurements...
You mention a footpath, do you have a local land accss forum, if you make the footpath safer they may see it as planning gain to allow your change of use.
